Bomnal – General Terms and Conditions

  1. Scope of application: These General Terms and Conditions (GTC) apply to all services provided by Bomnal GmbH (registered office: Akademiestraße 7, 40213 Düsseldorf) to customers (§13 BGB); the contractual partner is Bomnal GmbH and its employed tattooists. In the case of guest tattoo artists, customers enter into a direct contractual relationship with the respective artists. Accordingly, liability is transferred in full to the respective Guest Artists.
  2. A declaration of consent must be completed before tattooing, which is only possible in conjunction with a valid identification document (identity card / passport / residence permit). The signature obliges the tattooist to follow the agreed instructions regarding hygiene measures and care of the freshly inked tattoo until it is completely healed.
  3. Clients are obliged to inform the respective tattooist about possible allergies, medication, pregnancy or illnesses (e.g. HIV, hepatitis, epilepsy, wound healing disorders, etc.), this also applies in the event that these only become known after the order has been placed and/or after the tattoo work has been carried out. As a matter of principle, we do not tattoo people who are under the influence of drugs or alcohol, who are taking blood-thinning medication, or who are pregnant or breastfeeding. If customers make false statements against their better knowledge or conceal the above-mentioned circumstances, Bomnal GmbH reserves the right to take civil and/or criminal action against the client and, under certain circumstances, to demand an allowance corresponding to the risk even after the work has been carried out.
  4. We reserve the right to reject customers without justification. This applies in particular to political design proposals, racist, sexist, anti-Semitic and/or homophobic tattoo proposals, as well as those that could be construed as offensive, obscene, harassing or fraudulent. Fraudulent, deceptive or misleading motives are also rejected without exception. Customers shall indemnify us against all claims and demands of third parties relating to the tattoo motif/design template. Customers grant Bomnal GmbH a right to use, reproduce and publish all photographs taken of the work produced free of charge and without any restrictions in terms of content, space or time. We cannot and will not check whether a graphic or photographic template provided to us by a customer is free of third-party rights.
  5. The price for a tattoo includes possible touch-ups and must be paid in full in cash at the end of the tattoo session. The deposit for booking the tattoo appointment will be offset against the final price.
  6. We charge a flat booking fee for appointments, which is offset against the final price after receipt of the tattoo. If an appointment is not postponed at least 3 working days in advance by written notification by e-mail or telephone agreement, we will retain this deposit, as we are usually unable to reschedule the appointment. A new deposit is then due for a new tattoo appointment. In the event of unannounced non-appearance at appointments, the booking deposit will also be retained as compensation for consulting services, drawings incurred and preparatory work.
  7. Gift vouchers can be purchased from us in the studio in any amount, these are not paid out, not even in installments.
  8. Our services are offered in compliance with all known hygiene measures and using EU-certified materials. All instruments are cleaned, disinfected and sterilized before the procedure. Only commercially available tattoo inks approved in the EU, new needles in sterile packaging and a sterile handle are used for tattooing. Customers acknowledge their obligation to follow the instructions communicated by Bomnal GmbH regarding the hygiene and care of the tattoo to the best of their knowledge and belief until the tattoo is completely healed. Bomnal GmbH cannot accept any liability if clients are harmed by the service, this refers in particular, but not exclusively, to physical conditions, medical or medicinal conditions or activities outside the Bomnal GmbH studio.
  9. Unfortunately, despite high professional standards, there can always be unintended deviations from the desired motif (e.g. blowouts etc.), especially with cover-ups of old tattoos and/or scarred tissue. Customers undertake to comply with the instructions given regarding hygiene and care of the tattoo until it is completely healed. In rare cases, allergies can occur due to the tattoo ink. If laser treatment has been carried out on the corresponding skin areas prior to tattooing, this can have a negative effect on the quality and durability of the tattoo. The same applies to areas of skin that are already scarred. No liability can be accepted for undesirable optical effects, color deviations, scarring, color gradients, wound healing disorders and/or other undesirable consequences of tattooing laser-treated or otherwise scarred skin. By signing the declaration of consent, customers expressly release Bomnal GmbH from all liability for damages that may arise directly or indirectly as a result of the tattoo. For tattoos by guest tattoo artists, customers enter into a direct contract with the respective artists. Accordingly, the case of liability is transferred in full to the guest tattoo artist. Persons under the age of 18 will not be tattooed.
  10. No liability is assumed for the orthographic correctness of a tattoo – regardless of the language. The same applies to dates etc. in foreign formats. Customers are expressly requested to ensure that the desired lettering has the correct spelling and orthography before the actual tattooing is carried out.
  11. Customers undertake to behave appropriately during a visit to the studio. If customers or accompanying persons continue to behave inappropriately even after a warning, tattoo artists, employees and the manager have the right to expel people from the studio and ban them from the premises.
  12. Customers declare their agreement with the GTC upon conclusion of the contract; furthermore, in the event of complications, customers waive the right to assert claims for damages or other resulting costs of any kind against the tattoo studio, tattoo artist/employees/managers/company and its suppliers.
  13. We are not liable for the loss or destruction of personal belongings brought into the Bomnal GmbH tattoo studio. We would like to point out that clothing and footwear will not be replaced if soiled or damaged by paint, disinfectants or other materials, unless the soiling or damage was caused by gross negligence or intent.
  14. Tattoos constitute bodily harm according to §§ 223, 223a, 224 StGB. By placing an order, customers expressly consent to the offense of bodily harm within the meaning of § 226a StGB and bear responsibility for it themselves. Bomnal GmbH keeps the risks of errors or inflammation as low as possible and informs its customers about the risks and possible side effects of a tattoo. By placing an order, customers declare that they are sufficiently informed about the possible risks and consequential risks of a tattoo and accept them by placing an order. If any questions or complications arise, contact the studio immediately and consult a doctor or hospital.
  15. Severability clause: Should individual provisions of the GTC be invalid or void in whole or in part or become invalid or void in whole or in part as a result of a change in the legal situation or through supreme court rulings or in any other way, or should this contract contain loopholes, the parties agree that the remaining provisions of the GTC shall remain unaffected and valid. In this case, the contracting parties undertake, taking into account the principle of good faith, to agree a valid provision in place of the invalid provision which comes as close as possible to the meaning and purpose of the invalid provision and which it can be assumed that the parties would have agreed at the time of conclusion of the contract if they had known or foreseen the invalidity or nullity.
